How We Went From a Victim of Patent Trolls to an Industry Leader: A Real Success Story!
Federal Patent Bureau "Zhelezno" is a relatively young organization, only 5 years old. We became a patent bureau due to attacks by patent trolls. Initially, we lost almost everything, but were able to turn the situation around 180 degrees. Now in Rospatent, we are the first in the number of applications filed for registration of trademarks.
Troll Attack
A Kirov company producing goods for men's hobbies faced an attack by patent trolls. The attackers copied the site, chose the most popular product and its name, applied for trademark registration with Rospatent and received it. Then they went to court and won the case. The help of a freelance lawyer was not effective.
As a result, the business was paralyzed: sales stopped, warehouses were seized, and products worth several million rubles were declared counterfeit.
This experience was a lesson for us and prompted us to take intellectual property protection seriously.
Don't delay registration
Advice: if you have decided on a product or service, chosen a name, do not delay with registering a trademark. Even if you are not sure whether you will remain in this niche, it is better to protect your rights in advance.
Check if your brand is already in use and apply to Rospatent. Registration guarantees you the exclusive right to use the trademark. Once you have submitted the application, you can start working safely. You will have two months to test your niche. If the business is successful, continue the registration process by paying all the necessary fees. Otherwise, do not pay anything and apply for registration in another niche.
The title is taken: what to do?
If you find that the name you have chosen has already been cambodia email list by another entrepreneur, do not despair. There is a way to register a trademark even if your companies operate in the same field. And if the fields are different, even better.
Try to negotiate with the owner of the brand that has taken your name. Explain that your activities do not intersect with their business, and offer to sign a letter of consent for your registration. If the company is accommodating and does not object to your mark, you will be able to register it without any problems.
However, be careful with companies that deliberately register many trademarks but do not use them. Such organizations often turn out to be trolls. Intellectual property experts have "blacklists" of such companies. If you encounter a troll, it is better to choose a different name.
