The RF Government Resolution of 19.01.1998 No. 55 ceased to be effective as of 01.01.2021. Many representatives of the trade sector were somewhat surprised by this fact.
In essence, Resolution No. 55 contains almost all the rules for the sale of certain types of goods. The procedure for the sale of medicines and medical products was also covered. Starting from 01.01.2021, Resolution No. 2463 came into force instead of Resolution No. 55. However, it cannot be said that any significant changes appeared in the new document. As in the previous resolution, the list of goods that are not allowed to be exchanged includes medicines and goods for the treatment and prevention of diseases at home (metal, rubber, textile and other hygiene and sanitation products, medical products, oral care products, children's care products, spectacle lenses).
The greatest confusion in replacing one regulation with another was caused by the fact that the new document does not mention the possibility or impossibility of return in any way. That is, the question arises: is it now allowed to return purchased drugs or products to the pharmacy? The answer is categorically negative! This requires separate clarification.
First of all, you should refer to the Law of the Russian Federation "On the Protection of Consumer Rights". It clearly describes consumer rights, including everything that concerns already purchased goods.

In particular, Article 25 of the said law states:
"The consumer has the right to exchange a non-food product of proper quality for a similar product from the seller from whom the product was purchased, if the said product does not fit in terms of shape, dimensions, style, color, size or configuration."
“A return is only possible if a similar product is not available for sale on the day the consumer contacts the seller.”
And the law also clearly states that “the list of goods that are not subject to exchange on the grounds specified in this article is approved by the Government of the Russian Federation.”
Here is the most important point: the Russian law allows exchanging a purchased product only if it is not on the list of products prohibited for exchange. Returning a product of proper quality is only permissible when this product is allowed for exchange, but at the time when the buyer asked the seller about this issue, the product was not available.
The RF Government Resolution No. 2463 states that medicines and products for disease prevention and home treatment are NOT subject to exchange (and they are included in the corresponding list). Thus, the mentioned goods cannot be exchanged, which means they are also not subject to return.
Today, instead of the previous Resolution No. 55, the rules for the sale of certain types of goods stipulated in the new Resolution No. 2463 are in effect. However, regarding the exchange and return of medicines and goods for disease prevention and home treatment, the law remains the same: the buyer can neither exchange nor return such products.
